Cortex Beauty offers this website, including all information, tools, products, and services available through www.cortexbeauty.com (the “Site”), to you conditioned upon your acceptance of these Terms of Service.

By visiting the Site, purchasing something from us, participating in the Cortex Beauty Mobile Messaging Program, or otherwise using our services, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms, conditions, and policies referenced in these Terms or made available by hyperlink.

These Terms apply to all users of the Site, including browsers, customers, vendors, merchants, and contributors of content.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to sell products and services to you.

You may not use a false email address, impersonate another person, or mislead us or others regarding the origin of a submission. You are responsible for the accuracy and legality of any content you submit.

Section 11: Cortex Beauty Mobile Messaging Program

Program Description

The Cortex Beauty Mobile Messaging Program provides recurring promotional and personalized marketing communications from Cortex Beauty.

Messages may include:

• Special offers and discounts

• Product announcements and recommendations

• Back-in-stock alerts

• Abandoned cart or checkout reminders

• Styling information and beauty-related content

• Other Cortex Beauty marketing communications

Messages may be delivered through Rich Communication Services (“RCS”), SMS, or MMS. If RCS is unavailable or unsupported by your device or mobile carrier, messages may be delivered through SMS or MMS.

Consent to Receive Messages

By providing your mobile telephone number and opting in to the Cortex Beauty Mobile Messaging Program, you expressly consent to receive recurring automated promotional and personalized marketing messages from Cortex Beauty at the telephone number you provided.

Messages may be sent using automated technology. Your consent to receive marketing messages is not a condition of purchasing any goods or services from Cortex Beauty.

You represent that you are the owner or authorized user of the telephone number provided and that you are authorized to consent to receive messages at that number.

Message Frequency and Charges

Message frequency varies.

Message and data rates may apply. Charges are determined by your mobile carrier and may appear on your mobile telephone bill or be deducted from your prepaid balance.

Cortex Beauty does not charge a separate fee for participating in the Mobile Messaging Program, but you are responsible for any messaging, data, or other charges imposed by your mobile carrier.

How to Opt Out

You may opt out of the Cortex Beauty Mobile Messaging Program at any time by replying STOP to any message.

After submitting an opt-out request, you may receive one final message confirming that you have been unsubscribed. You will no longer receive marketing messages from the program unless you separately opt in again.

Opting out of marketing messages will not prevent Cortex Beauty from sending non-marketing messages that are necessary to complete a transaction, provide requested customer service, protect your account, or comply with applicable law.

Delivery and Carrier Availability

Mobile carriers are not responsible for delayed or undelivered messages.

Message delivery is subject to the availability and performance of mobile networks, supported messaging services, compatible devices, and participating carriers. RCS features may not be available through every device or mobile carrier.

If an RCS message cannot be delivered, Cortex Beauty or its messaging provider may attempt to deliver the communication through SMS or MMS where supported and permitted.

Neither Cortex Beauty nor participating mobile carriers guarantee that messages will be delivered without delay or interruption.

Changing Your Telephone Number

If you change, transfer, or deactivate the telephone number used to enroll in the Mobile Messaging Program, you agree to opt out before changing or deactivating that number or to notify Cortex Beauty promptly.

You agree that failing to notify Cortex Beauty of a number change may result in messages being sent to the person who later receives that telephone number.

Privacy

Information collected through the Cortex Beauty Mobile Messaging Program is handled in accordance with our Privacy Policy.

We do not sell, rent, or share mobile messaging originator opt-in data or consent with non-affiliated third parties for their own marketing or promotional purposes.

Program Changes or Termination

We may modify, suspend, or terminate the Mobile Messaging Program or any of its features at any time.

We may also change the telephone number, short code, sender identification, RCS agent, or technology used to operate the program. We will provide notice when required by applicable law.

Your continued participation in the program after a change becomes effective constitutes acceptance of the updated Mobile Messaging Terms.

Section 12: Errors, Inaccuracies, and Omissions

Information on the Site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, delivery times, and product availability.

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information or cancel orders if information is inaccurate, including after an order has been submitted.

We have no obligation to update or clarify information except as required by law.

To the fullest extent permitted by law, Cortex Beauty disclaims implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

To the fullest extent permitted by law, Cortex Beauty and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages arising from your use of the Service or products purchased through the Service.

This limitation includes lost profits, lost revenue, lost savings, loss of data, replacement costs, and similar damages, whether based on contract, tort, strict liability, or another legal theory.

The unenforceable portion will be considered severed from these Terms and will not affect the validity or enforceability of the remaining provisions.

You may terminate these Terms by notifying us that you no longer wish to use the Service or by discontinuing your use of the Site.

If we reasonably believe that you have violated these Terms, we may terminate or suspend your access to the Service without notice. You will remain responsible for amounts owed through the date of termination.

The provisions of these Terms that reasonably should survive termination will remain in effect after termination.

These Terms and any policies or operating rules posted on the Site constitute the entire agreement between you and Cortex Beauty regarding your use of the Service.

These Terms supersede prior or contemporaneous agreements, communications, and proposals concerning your use of the Service.
